Sadly it is a recognised statistic that two woman a week are killed by
a violent partner or ex-partner in the UK each week.
If you are a victim of domestic violence it is possible
to seek protection from the court by way of a non-molestation order or
an occupation order in relation to property.
A non-molestation order can contain provisions prohibiting
the respondent from molesting another person who is associated with the
respondent; and/or prohibiting the respondent from molesting a relevant
child.
An occupation order regulates the occupation of a particular
property dependent upon the parties legal right to occupy the property
and the relationship between the parties.
When considering an application for an occupation order
the court will take into account all of the circumstances including the
housing needs and housing resources of each of the parties and of any
relevant child; financial resources of each of the parties; likely effect
of any order, or decision not to exercise its power on the health, safety
or well-being of the parties and any relevant child and the conduct of
parties in relation to each other and otherwise.
